THIS WEBSITE AND SERVICE CONTAIN ADULT-ORIENTED MATERIAL INTENDED FOR
CONSENTING ADULTS ONLY. BY ACCESSING, BROWSING, REGISTERING FOR, OR USING
SWINGERS AVENUE (THE “SITE,” “SERVICE,” OR “PLATFORM”), YOU AGREE TO BE BOUND BY
THESE TERMS OF SERVICE (“TERMS”). IF YOU DO NOT AGREE TO THESE TERMS IN THEIR
ENTIRETY, DO NOT USE THE SERVICE.
THESE TERMS CONTAIN IMPORTANT DISCLAIMERS OF LIABILITY, LIMITATIONS ON
DAMAGES, AND PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS, INCLUDING A
REQUIREMENT TO ARBITRATE DISPUTES. PLEASE READ THEM CAREFULLY.
1. Acceptance of Terms
These Terms of Service constitute a legally binding agreement between you (“you,” “your,”
“User,” or “Member”) and Swingers Avenue (“Swingers Avenue,” “we,” “us,” or “our”),
operator of the website located at https://www.swingersavenue.com, related mobile applications
(including any app accessible via Spaces or similar platforms), and associated online services
(collectively, the “Service”).
By accessing or using the Service in any manner, including creating an account, submitting an
application, viewing event information, participating in virtual meetups, or communicating with
other users, you represent that you have read, understood, and agree to be bound by these Terms,
our Privacy Policy (if and when published), and any additional guidelines or rules posted on the
Service.
We may update these Terms from time to time. The “Effective Date” at the top will be revised
accordingly. Your continued use of the Service after any changes constitutes acceptance of the
revised Terms. If you do not agree to the changes, you must stop using the Service.
2. Description of the Service
Swingers Avenue is an online platform and community that provides information,
recommendations, membership opportunities, virtual social events (such as Zoom meetups), an
application for connecting with like-minded adults, and listings or suggestions regarding venues,
nightclubs, hotels, and other locations where lifestyle (swingers) social gatherings may occur.
Swingers Avenue recommends places, venues, and locations for potential events and social gatherings. We may
list, promote, or share information about events, meet-and-greets, nightclub nights, hotel after-
parties, virtual Zoom sessions, or similar activities. However, Swingers Avenue does not itself
host, organize, operate, manage, supervise, or control any physical in-person events, parties, or
gatherings. Any physical events referenced on the Service are organized, hosted, and controlled
solely by independent third parties (including venue owners, independent promoters, co-host couples, or individual members). We have no ownership, control, or operational responsibility over any such third-party venues or events.
The Service may also include membership applications, peer verification processes, affiliate or
co-host opportunities, content creator sections, blog content, and referrals to other lifestyle
platforms or apps. All such features are provided solely as informational and networking tools.
3. Eligibility and Age Requirement
The Service is intended solely for adults who are at least twenty-one (21) years of age. By using the Service, you represent and
warrant that:
• You are at least 21 years old 
• You have the legal capacity to enter into a binding contract;
• You are not prohibited from using the Service under any applicable law;
• All information you provide is truthful and accurate.
Access by anyone under 18 is strictly prohibited. We reserve the right to request proof of age
at any time and to terminate accounts that we reasonably believe belong to minors.
4. Account Registration, Membership Applications, and Verification
Certain features of the Service (including event recommendations, virtual meetups, or
membership benefits) may require registration or submission of an application. You agree to
provide accurate, current, and complete information and to update it as necessary.
Swingers Avenue may use a peer-review or member-verification process. This process is
informal and provided solely for community convenience. It does not constitute a background
check, identity verification by us, criminal history screening, or any guarantee of authenticity or
safety.
You are solely responsible for maintaining the confidentiality of your account credentials and for
all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
5. Event Recommendations – We Do Not Host Events. Swingers Avenue recommends places and venues for events.
Any information, listings, calendars, RSVP links, ticket links (including via Eventbrite or
similar), Zoom details, or promotional materials appearing on the Service regarding nightclub
events, meet-and-greets, hotel parties, body-marbling events, VIP nights, virtual Primetime
Zoom events, or any other gatherings are provided for informational and referral purposes only.
You expressly acknowledge and agree that:
(a) Swingers Avenue is not the host, organizer, promoter (in the legal sense of assuming
liability), operator, or controller of any physical event;
(b) Venues, third-party promoters, co-host couples, or individual members are solely
responsible for the planning, safety, security, rules, admission, and conduct of any in-
person gathering;
(c) Ticket purchases, door fees, or membership payments related to events may be processed
through third parties (including Avenue Tickets or Eventbrite) and are subject to those
third parties’ own terms;
(d) We make no warranties regarding the accuracy of event details, whether an event will
occur as described, the quality or safety of any venue, or the conduct of any attendees.
6. We Do Not Vouch for People – No Endorsement of Members or Attendees
Swingers Avenue does not vouch for, endorse, recommend, guarantee, or assume any
responsibility for the character, identity, intentions, criminal history, health status
(including STI/STD status), financial reliability, or safety of any member, user, applicant,
co-host, venue staff, or any other person you may encounter through the Service or at any
recommended event.
Peer verification, member reviews, profile information, photographs, or statements made by
other users are not verified or authenticated by us in any official capacity. You interact with
other adults at your own sole risk.
We are not a dating service that performs background checks, nor are we a matchmaking agency
that screens participants. Any connections, meetings, communications, or intimate encounters
that result from use of the Service are entirely between the individuals involved.
7. Your Safety Is Your Responsibility
You are solely and exclusively responsible for your own personal safety, health, and well-
being when using the Service or attending any event or meeting arranged through or
recommended by the Service.
We strongly recommend that you:
• Exercise extreme caution when meeting anyone in person for the first time;
• Meet in public places initially and inform a trusted friend of your plans;
• Never share sensitive personal information (home address, financial details, etc.)
prematurely;
• Obtain clear, affirmative, ongoing consent for any physical or intimate activity;
• Practice safer sex and discuss sexual health openly and honestly;
• Trust your instincts – if something feels wrong, leave immediately;
• Report any concerning behavior to local law enforcement and, where appropriate
Swingers Avenue has zero tolerance for non-consensual activity, harassment, violence, or illegal
conduct. However, we are not present at events and cannot monitor or control real-world
interactions. Reporting a problem to us does not create any duty on our part to intervene beyond
what is required by law.
8. User Conduct and Prohibited Activities
You agree to use the Service only for lawful purposes and in accordance with these Terms. You
shall not:
• Post, transmit, or promote any content involving minors (anyone under 18), non-
consensual acts, violence, illegal drugs, trafficking, or any other illegal activity;
• Harass, stalk, threaten, doxx, or intimidate other users;
• Impersonate any person or entity or misrepresent your identity or affiliations;
• Use the Service for commercial solicitation or escort services
• Upload viruses, malware, or engage in any activity that disrupts the Service;
• Scrape, harvest, or collect personal data of other users without consent;
• Violate any applicable local, state, national, or international law.
We reserve the right, but have no obligation, to monitor content, investigate complaints, remove
content, suspend or terminate accounts, and cooperate with law enforcement at our sole
discretion. Any illegal activities will be reported to the authorities.
9. User Content and Intellectual Property
You retain ownership of content you submit (photos, profiles, messages, etc.), but you grant
Swingers Avenue a worldwide, non-exclusive, royalty-free, transferable license to use,
reproduce, display, and distribute such content in connection with operating and promoting the
Service.
You represent that you have all necessary rights to the content you post and that it does not
infringe any third-party rights or violate these Terms.
All trademarks, logos, text, graphics, and software on the Service (excluding user content) are
the property of Swingers Avenue or its licensors and are protected by intellectual property laws.
You may not copy, modify, or distribute any portion of the Service without our prior written
consent.
10. Memberships, Fees, and Payments
Certain memberships, event-related fees, or premium features may require payment. All fees are
non-refundable except as required by applicable law or as expressly stated in writing by us.
Payments processed through third-party processors (including Eventbrite, Avenue Tickets, or
payment gateways) are subject to those processors’ terms and privacy policies.
We reserve the right to change pricing and membership structures at any time. Failure to pay
applicable fees may result in suspension or termination of access.
11. Disclaimers of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT
WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY,
INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY,
SWINGERS AVENUE – TERMS OF SERVICE
FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT,
ACCURACY, OR RELIABILITY.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-
FREE, SECURE, OR FREE OF VIRUSES. WE DO NOT WARRANT THE ACCURACY OF
ANY EVENT INFORMATION, MEMBER PROFILES, OR THIRD-PARTY CONTENT.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM
US OR THROUGH THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY
STATED IN THESE TERMS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SWINGERS
AVENUE, ITS OWNERS, OPERATORS, AFFILIATES, OFFICERS, DIRECTORS,
EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR
EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS,
DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR
RELATING TO:
• Your use of or inability to use the Service;
• Any interactions, meetings, communications, or encounters with other users or third
parties;
• Any physical event, venue, or gathering recommended, listed, or referred to on the
Service;
• Any injury, illness, death, property damage, emotional distress, sexual contact, STI
transmission, assault, theft, or other harm occurring at or in connection with any event or
meeting;
• Any unauthorized access to or alteration of your transmissions or data.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS
ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED
THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12)
MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, the
above limitations shall apply to the fullest extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Swingers Avenue and its owners, operators,
affiliates, officers, directors, employees, and agents from and against any and all claims,
damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’
fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your
violation of any third-party right; (d) any content you submit; or (e) any interaction or encounter
you have with other users or at any recommended event.
SWINGERS AVENUE – TERMS OF SERVICE
14. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or
notice, including for violation of these Terms, suspected illegal activity, or for any other reason
in our sole discretion. Upon termination, your right to use the Service ceases immediately.
Sections that by their nature should survive (including disclaimers, limitations of liability,
indemnification, and governing law) shall survive termination.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of
Texas, United States of America, without regard to its conflict of laws principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall
first be attempted to be resolved through good-faith negotiation. If unresolved within thirty (30)
days, the dispute shall be resolved by binding arbitration administered by the American
Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place
in a mutually agreed location in Texas, or virtually. Judgment on the award may be entered in
any court of competent jurisdiction.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a
court of competent jurisdiction to protect intellectual property or confidential information. YOU
AND SWINGERS AVENUE EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO
PARTICIPATE IN A CLASS ACTION.
16. Miscellaneous
Entire Agreement. These Terms, together with any Privacy Policy and any other policies posted
on the Service, constitute the entire agreement between you and Swingers Avenue concerning
the Service and supersede all prior agreements.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining
provisions shall continue in full force and effect.
Waiver. No waiver of any term shall be deemed a further or continuing waiver of such term or
any other term.
Assignment. You may not assign these Terms without our prior written consent. We may assign
these Terms freely.
Force Majeure. We shall not be liable for any failure or delay resulting from circumstances
beyond our reasonable control.

THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND
BY THEM. YOU UNDERSTAND THAT WE RECOMMEND PLACES FOR EVENTS
BUT DO NOT HOST THE EVENTS. YOU UNDERSTAND THAT WE DO NOT VOUCH
FOR ANY PERSON AND THAT YOUR SAFETY IS ENTIRELY YOUR OWN
RESPONSIBILITY
